2024 People's Choice voting terms and conditions

Sunshine Coast National Art Prize

1. The 'Promoter' is Sunshine Coast Regional Council, 22 Omrah Avenue, Caloundra, Queensland.

2. Information on how to enter and the prize forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

3. Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are eligible to enter.
 
4. Promotion commences on Friday 28 June, 2024 and closes on Sunday 22 September. (The ‘Promotional Period')

5. To enter, eligible entrants must, during the Promotional Period, vote for their chosen Sunshine Coast Art Prize 2024 finalist either by:

a. visiting the Caloundra Regional Gallery to view the artworks and completing the official entry form on the Caloundra Regional Gallery website, or
b. viewing the artworks online and completing the official entry form on the Caloundra Regional Gallery website .

6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7. Incomplete, indecipherable or illegible entries will be deemed invalid.

8. Only one (1) entry per person may be submitted.

9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

10. The draw for winner of the People’s Choice voting gift voucher will take place at Caloundra Regional Gallery, 22 Omrah Avenue, Caloundra QLD 4551 on Monday 23 September 2024. The winner will be notified by phone and/or email by Friday 27 September 2024. The Promoter’s decision is final and no correspondence will be entered into.

11. The first valid entry drawn will win the prize of a $100 Gallery Store voucher.

12. If for any reason the winner does not take the prize within the 12-month validity the prize will be forfeited.

13. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

14. Total voter prize pool value is $100. The prize, or any unused portion of the prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

15. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or death, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) the acceptance or use of a prize; (g) any act or omission of the Promoter or its associated agencies.

18. By entering this competition, you will be required to provide your personal information (including without limitation your name, telephone number and e-mail address to the Promoter). The Promoter will treat any personal information provided by a person who enters this competition in accordance with the Sunshine Coast Regional Council Privacy Policy, available on Council’s website. Your personal information is only accessed by persons authorised to do so.

19. The Promoter collects your personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages, sending a message by post or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

20. All entries will be entered into the Caloundra Regional Gallery database and receive regular gallery updates.
